RIGHTS RESERVED AND LIMITS OF RESPONSIBILITY IMPORTANT NOTICE — PLEASE READ

1. Introduction

Any and all information contained herein is in effect at the time of printing and is subject to change at any time. Itinerary arrival and departure times are always subject to change without notice.

Information contained in this brochure does not form part of any offer or contract. The transportation of guests and baggage on Silversea vessels is provided solely by Silversea and is governed by the terms and conditions printed on the Passage Contract. The Passage Contract will be included with your travel documents, is available upon request, or can be accessed through the website at www.Silversea.com, and contains complete and important information regarding cancellations, itineraries, Silversea’s liability, health and immigration requirements, and other relevant terms and conditions. By making a reservation and paying your deposit you agree to be bound by the terms and conditions of the Passage Contract. To the extent that any of the information in the brochure conflicts with the terms of the Passage Contract, the terms and conditions contained in the Passage Contract shall control.

Silversea shall have the right to cancel or alter the ship’s advertised route, to delay any sailing, substitute another vessel for the scheduled ship, or substitute or cancel scheduled ports of call which, in its sole judgment and discretion, is justified for any reason and to do so without liability for damage or for any loss to guests. Additionally, Silversea reserves the right to cancel reservations and bookings in the event of a full-ship charter or for any other reason, whether or not a deposit or full payment has been received. In such event, Silversea’s only liability will be to refund to the guest the amount it has received.

Silversea makes arrangements for transportation, other than ocean passage, only as a booking agent. Silversea’s responsibility does not extend beyond the vessel. In arranging for the transportation of guests to and from the ship, Silversea does so with independent contractors. Silversea is not responsible for incidents such as airline cancellations, re-routings or any disruption of scheduled services or accommodation, or lost luggage.

All schedules, fares, and terms and conditions listed in this brochure are effective as of April 2008 and supersede any schedules, prices, and terms and conditions previously published. All fares indicated in this brochure including land, air and hotel, are subject to change at anytime without notice. Special savings and programmes on designated sailings are all subject to change and/or cancellation without notice.

Deposit or payment for a reservation constitutes consent to all terms and conditions contained in the Passage Contract. Please read your Passage Contract carefully.

5. Early Embarkation / Late Disembarkation

The fee for the Early Embarkation Programme is $100 per guest. The fee for the Late Disembarkation Programme is $100 per guest. If a guest’s suite is available and they wish to have access to it throughout the day, the Late Disembarkation Programme fee is $150 per guest. This programme is offered on 2009 voyages only.

Guests participating in the Early Embarkation Programme must preregister a minimum of seven days prior to departure (via Guest Information Form received in pre-cruise documentation) and provide Silversea with their anticipated arrival time at the ship. Early Embarkation will not be permitted until terminal is clear of disembarking guests and not prior to 10:30am. Every effort will be made to have the guest’s assigned suite available. The Restaurant will be open for lunch on embarkation day. The Early Embarkation Programme is only available in standard embarkation ports, is capacity controlled and may not be available on every voyage. Guests taking advantage of the Early Embarkation Programme may not be able to embark with their luggage, which may need to be stored in a secure shoreside facility. Charges may apply (varies by port). Guests will be contacted if the Early Embarkation Programme is not available for their particular cruise.

All arrangements for Late Disembarkation must be made through the Concierge aboard ship and must be arranged at least 24 hours prior to disembarkation. All guests and their luggage must clear Customs upon the ship’s arrival in port on disembarkation day. Guests participating in the Late Disembarkation Programme will be allowed back onboard without luggage. All luggage will be stored in a secure shoreside facility. Charges may apply (varies by port). Guests participating in the Late Disembarkation Programme will be allowed to remain onboard until 5pm (subject to ship’s sailing time). The Late Disembarkation Programme after 5pm is not available. The Restaurant will be open for lunch on disembarkation day. Due to customs regulations, Late Disembarkation is not available in any US port and may not be available in other ports outside of the U.S.

Selection of the Early Embarkation Programme or the Late Disembarkation Programme forfeits any group transfer to or from the pier included in a guest’s fare. Silversea will be happy to assist guests with private transfer arrangements.

Silversea will not be responsible for luggage stored shoreside for either the Early Embarkation Programme or the Late Disembarkation Programme.

6. Grand Inaugural Voyage Cancellations

SAVINGS & FARES :
All fares quoted are cruise-only, in U.S. dollars per guest based on double occupancy in an Vista Suite and reflect the highest savings available for each voyage. Port charges, government fees and taxes are additional. Fares may include Early Booking Incentive savings of up to 35%, an additional 15% Extended Advance Payment Bonus (XAPB) when paid in full one year prior to sailing by March 31, 2009 for voyages 5001–5007, plus a 5% Extended Voyage Savings (EVS). Venetian Society member fares for the full Grand Inaugural Voyage 2010 or for the featured segments may vary from fares shown, contingent upon the member’s total number of days travelled with Silversea. Detailed fare information will be confirmed at time of reservation. Single supplements start from 25% of the double occupancy fare and may vary by category. Savings are capacity-controlled, subject to availability and may change at any time without notice. Savings do not apply to the Silver SKY Air Programme, Land Programmes, Silver Sights, or port charges and government fees. Other restrictions may apply.

DEPOSIT & PAYMENT :
To reserve a suite on the Grand Inaugural Voyage 2010, 91 day Fort Lauderdale to New York or voyage segments of 60 days or longer, a 20% deposit of the total cruise fare is required and for voyage segments of 9 – 59 days, a 10% deposit of the total cruise fare is required. Deposits must be received within seven days of booking or less, depending on time of booking. Unless otherwise noted, final payment must be received by Silversea 90 days prior to cruise departure. For bookings made within 30 days of departure, final payment must be received within 48 hours. Silversea reserves the right to cancel any booking not fully paid at the time final payment is due. Payment may be made by travellers cheque, VISA®, Master Card®, American Express®, Discover®, Diners Club® or JCB card.

CANCELLATIONS & REFUNDS :
Silversea’s cancellation penalties are strictly enforced. Cancellation requests must be addressed to and received in writing at Silversea Reservations, 110 East Broward Blvd, Fort Lauderdale, Florida, 33301, USA. Cancellation requests for guests booked on the full Grand Inaugural Voyage 2010, or any combination of segments will be subject to the following charges, regardless of suite resale:

From the date of deposit to 121 days prior to sailing :
• $250 per guest sailing in a Vista, Veranda or Midship Veranda Suite
• $500 per guest sailing in a Silver, Grand, or Owner’s Suite
120 – 91 days prior to your initial sailing date:
• 15% of the total cruise fare per guest
90 – 46 days prior to your initial sailing date:
• 50% of the total cruise fare per guest
45- 31 days prior to your initial sailing date:
• 75% of the total cruise fare per guest
30 – 0 days prior to your initial sailing date or non-appearance at the time of sailing:
• 100% of the total cruise fare per guest

PENALTIES : SAILING 9-59 DAYS:
120 – 91 days prior to your initial sailing date:
• $200 per guest
90 – 61 days prior to your initial sailing date:
• 10% of the total cruise fare per guest
60 – 31 days prior to your initial sailing date:
• 20% of the total cruise fare per guest
30 – 15 days prior to your initial sailing date:
• 50% of the total cruise fare per guest
14 – 0 days prior to your initial sailing date, or non-appearance at the time of sailing:
• 100% of the total cruise fare per guest

All refunds are subject to incurred costs for hotel, air and ground services where applicable. In addition, guests cancelling the Silver SKY Air Programme package fare between 90 – 61 days prior to initial sail date will incur a penalty equal to 10% of the Silver Sky Air Programme package fare. Air Programme package fare varies depending on class of air service purchased, e.g. Economy, Economy Plus, Business or First class. When cancelled 60 – 0 days prior to initial sailing date, the Silver SKY Air Programme package is 100% non-refundable, including Change Fees previously incurred. Hotel, Silver Sights and Land Programme penalties apply to cancellations received within 90 – days of initial cruise departure and vary from $100 per person up to 100% of the full package price, depending on date of cancellation. Silversea is unable to provide refunds for tickets not used (in whole or in part), or for guests failing to bring travel and health documents as required. Guests who are booked on the Grand Inaugural Voyage 2010 who cancel any portion of the cruise, will have their entire booking cancelled and will be rebooked on the revised segment(s) subject to space available at the time of change. Guests booked on the full 91 – day Grand Inaugural Voyage 2010 in a Silver Suite or a higher suite category, who cancel any portion of the cruise will forfeit their suite. Silversea reserves the right to allocate suites or suite categories to specific combination segments, hence all suites or suite categories may not be available for specific segments or segment combinations. Travel date changes are subject to cancellation penalties.

SHIPBOARD ACCOUNT :
Upon embarkation, guests will be asked to register their VISA®, Master Card®, American Express®, Discover®, Diners Club® or JCB credit card number and expiration date, which must be valid through the final day of their voyage. All charges for services provided and products purchased onboard must be settled in cash, by travellers cheque, or above listed credit card at the end of each voyage segment and before final disembarkation from the ship.

*ONBOARD SPENDING CREDIT can be used towards shore excursions, spa treatments, premium selections from the Connoisseur List of wines and spirits, alternative restaurant dining fees, and/or purchases in the onboard boutiques. Offer is per suite, not per voyage, and may only be applied once on combined voyages. Single occupancy suites will receive Onboard Spending Credit of $500 – $1,000. Onboard Spending Credit may not be redeemed for cash and any unused portion will be forfeited. Onboard Spending Credit is valued in U.S. dollars, regardless of booking currency. Other restrictions may apply.

Silver Savings
Silver Savings are capacity controlled and offered on a first-come, first-served basis. Savings of 30%–50% apply to all categories on the Prince Albert II and Vista, Terrace, Veranda and Midship Veranda suite categories on the remaining ships. A limited number of premium suites — Medallion, Silver, Royal, Grand and Owner’s — are available with Silver Sailing savings of 20%–40%. Call for pricing. Savings are not combinable with Early Booking Incentive, Advance Payment Bonus or other promotional offers, but may be combined with Venetian Society and Extended Voyage Savings if applicable. Silver Sailing savings may be decreased or withdrawn at any time without notice.

Fares shown on the Prince Albert II are cruise only, in U.S. dollars, per guest based on double occupancy in Adventurer Class. Fares shown for the remaining ships are cruise-only, in U.S. dollars, per guest based on double occupancy in a Vista Suite. Single occupancy rates are available upon request. Other restrictions may apply. Ships' registry: Bahamas.

Beginning in 2010, Silver Savings will be up to 60% off published cruise-only fares for select voyages, in all suite categories. Silver Savings are capacity controlled, subject to availability and may change at any time without notice. Silver Savings could decrease or be closed for specific suite categories or entire voyages. Contact your travel professional or Silversea to determine the Silver Savings available at the time of booking your voyage(s).

Silver Savings represent savings from the published fare and may not be combined with certain other promotional offers. Some cruise credits may not be combinable.

Venetian Society (VS) Savings
On select voyages, past guests of Silversea save an additional percentage as indicated by voyage. This savings is in addition to the special savings in effect at the time of booking. Savings are capacity controlled, subject to availability and may change at any time without notice.

Extended Voyage Savings (EVS)
Combine two or more consecutive voyages and save an additional 5% on each voyage selected. Savings may vary by voyage and are subject to change or withdrawal without notice. Savings are applicable to full published voyages, but not to segments of the same voyage. Extended Voyage Savings are in addition to special savings and Venetian Society Savings, if applicable, but may not be combined with other promotional offers. Contact your travel professional or Silversea for applicable savings. Other restrictions apply.

Onboard Savings
Onboard guests save up to 5% off future voyages when booked whilst sailing.

Venetian Society Savings, Onboard Savings and Extended Voyage Savings are applied sequentially to Silver Savings fares and after all Air Credits have been deducted.

Savings programmes do not apply to Silver SKY Air Programme fares, Silver Shore Simply/Grande Hotel Programmes, Land Adventures or port charges, government fees and taxes.

All travel documents (air and cruise tickets, passport, medical card, inoculation verification) are the guest’s responsibility. It is also the guest’s responsibility to obtain any necessary visas and public health documents for all applicable ports and to comply with all customs requirements. Without the required documents, a guest may be denied boarding and accommodation by Silversea, or the guest may be disembarked during the voyage and Silversea will not make a refund or be otherwise liable to any guest for such denial of boarding or disembarkation. In the event Silversea as a courtesy provides information or advice as to necessary travel documents, visas and medical inoculations, guests are still obligated to verify such information with the appropriate government authorities and Silversea does not warrant or guarantee the accuracy of such information. Some countries require passports to be valid six months beyond intended stay. Please check with the appropriate consulate for specific requirements.

For cruises that include Canadian ports, please contact your local Canadian Consulate for Canadian travel requirements.

Security measures imposed by governments may change from time to time and each guest will be required to comply with them. Silversea will endeavour to provide each guest with notice of measures which may affect them, but complying with any such requirements is the sole responsibility of each guest. Please consult your travel agent for advice on such requirements to avoid loss of boarding privileges.

INOCULATIONS
Generally, inoculations are not required in most areas where Silversea travels. Please note that when traveling to countries that do not require inoculations, written verification will be necessary. These requirements are subject to change and we recommend that you verify current guidelines with your travel agent prior to departure. Before taking any trip overseas, it is wise to check with your doctor, particularly if you are under a doctor’s care.
